Machines that learn and think like people must be able to learn from others. Social learning speeds up the learning process and – in combination with language – is a gateway to abstract and unobservable information. Social learning also facilitates the accumulation of knowledge across generations, helping people and artificial intelligences learn things that no individual could learn in a lifetime.

The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. An examination of the emotional rejection of the cultural and intellectual force of science that threatened the acceptance of revelation as the true measure of human nature and only basis for religion by prominent Christian theologian John Henry Newman. Newman argued from the pulpit and in writing as a member of the Church of England early in his career and later as a Catholic cardinal, that science violated religious dogma and negated the authority of the Church under the guise (...) of obtaining information only God could possess. Deeply pessimistic, he criticized the British Association for the Advancement of Science for legitimizing natural theology, embracing the optimistic view of man’s ability to improve life through discovery, and advocating ecumenical and commercial aspects of scientific knowledge. Newman called for contemporary Christians to maintain their obedience to God, reject natural theology as a true religion, refuse to substitute science for religion, and dismiss the belief that advancing knowledge could lead to a higher religious standard. Throughout the biological and biomedical sciences there is a growing need for, prescriptive ‘minimum information’ (MI) checklists specifying the key information to include when reporting experimental results are beginning to find favor with experimentalists, analysts, publishers and funders alike. Such checklists aim to ensure that methods, data, analyses and results are described to a level sufficient to support the unambiguous interpretation, sophisticated search, reanalysis and experimental corroboration and reuse of data sets, facilitating the extraction of maximum value from data sets (...) them. However, such ‘minimum information’ MI checklists are usually developed independently by groups working within representatives of particular biologically- or technologically-delineated domains. Consequently, an overview of the full range of checklists can be difficult to establish without intensive searching, and even tracking thetheir individual evolution of single checklists may be a non-trivial exercise. Checklists are also inevitably partially redundant when measured one against another, and where they overlap is far from straightforward. Furthermore, conflicts in scope and arbitrary decisions on wording and sub-structuring make integration difficult. This presents inhibit their use in combination. Overall, these issues present significant difficulties for the users of checklists, especially those in areas such as systems biology, who routinely combine information from multiple biological domains and technology platforms. To address all of the above, we present MIBBI (Minimum Information for Biological and Biomedical Investigations); a web-based communal resource for such checklists, designed to act as a ‘one-stop shop’ for those exploring the range of extant checklist projects, and to foster collaborative, integrative development and ultimately promote gradual integration of checklists. We provide a retrospective of 25 years of the International Conference on AI and Law, which was first held in 1987. Fifty papers have been selected from the thirteen conferences and each of them is described in a short subsection individually written by one of the 24 authors. These subsections attempt to place the paper discussed in the context of the development of AI and Law, while often offering some personal reactions and reflections. As a whole, the subsections build into (...) a history of the last quarter century of the field, and provide some insights into where it has come from, where it is now, and where it might go. George Herbert Mead, one of America’s most important and influential philosophers, a founder of pragmatism, social psychology, and symbolic interactionism, was also a keen observer of American culture and early modernism. In the period from the 1870s to 1895, Henry Northrup Castle maintained a correspondence with family members and with Mead—his best friend at Oberlin College and brother-in-law—that reveals many of the intellectual, economic, and cultural forces that shaped American thought in that complex era. Close friends of John Dewey, (...) Jane Addams, and other leading Chicago Progressives, the author of these often intimate letters comments frankly on pivotal events affecting higher education, developments at Oberlin College, Hawaii, progressivism, and the general angst that many young intellectuals were experiencing in early modern America. The letters, drawn from the Mead-Castle collection at the University of Chicago, were collected and edited by Mead after the tragic death of Henry Castle in a shipping accident in the North Sea. Working with his wife Helen Castle, he privately published fifty copies of the letters to record an important relationship and as an intellectual history of two progressive thinkers at the end of the nineteenth century. American historians, such as Robert Crunden and Gary Cook, have noted the importance of the letters to historians of the late nineteenth century. The letters are made available here using the basic Mead text of 1902. Additional insights into the connection between Mead, John Dewey, Henry and Harriet Castle, and Hawaii’s progressive kindergarten system are provided by the foundation’s executive director Alfred L. Castle. Marvin Krislov, president of Oberlin College, has added additional comments on the importance of the letters to understanding the intellectual relationship that flourished at Oberlin College. Giving advice to Henry Bolingbroke was a pastime that could be very rewarding or very dangerous. Consider the following two cases. In May 1401, a little over nineteen months after Henry had deposed his cousin Richard and ascended the throne, his friend and confessor Philip Repyngdon, at that time the abbot of St. Mary de Prè in Leicester and chancellor of Oxford, sent Henry a long letter about the condition of the realm. Henry had personally requested (...) such a report, according to the version of the letter preserved in Adam of Usk's Chronicle: “Whereas your singular serenity did require of me, the least of your servants, when last I went out from before you with heavy heart, that, if I should hear aught adverse, I should make it known unto your excellency without delay, now, as your most obedient servant, do I take my pen in hand to show what I have heard and seen.” And Repyngdon had apparently heard and seen a lot, as he claimed that “law and justice are banished from the realm; thefts, murders, adulteries, fornications, extortions, oppressions of the poor, hurts, wrongs, and much reproach, are rife; and one tyrant will doth serve for law.”. The Bayesian view of inference has become popular in philosophy in recent years. Scientific Reasoning: a Bayesian Approach, by Colin Howson and Peter Urbach, represents an articulate and persuasive defense of the Bayesian view. We focus on the theme of that book, and argue that there are difficulties with Bayesianism, and alternatives worth considering. One of the most serious drawbacks to Bayesianism is the subjectivity that pervades most versions of it. We argue that this is an instance of a more (...) general contemporary tendency to move away from claims of objectivity, and toward frankly subjective views. This results from a desire to find a deductive, incorrigible, basis for scientific inference. We claim that such a desire is doomed to frustration, but that does not spell the end of efforts to formalize inductive reasoning. (shrink)

More's Latin reply to Bugenhagen, given here with a facing English translation, is a comparatively brief but intense rebuttal of the principal points of Lutheran teaching concerning scripture ant tradition, faith and works, grace and free will, clerical celibacy, and the sacraments. It presents arguments elaborated at much greater length in More's other polemical works. _Supplication of Souls_ refutes _A Supplication for the Beggars_, an anticlerical pamphlet by Simon Fish which Henry VIII seems to have regarded with some favor. (...) More places his response in the mouths of the souls in purgatory. In the first book, he contemptuously demolished Fish's loose railery with accurate statistics and historical analysis. In the second, he defends the traditional doctrine of purgatory with brief arguments drawn from reason and a detailed analysis of scriptural passages. _Letter against Frith_ answers John Frith's Zwinglian arguments against the physical presence of Christ in the more. Written to an unknown correspondent, it is the briefest and mildest of More's polemical works and anticipates arguments presented moer elaborately in More's _The Answer to a Poisoned Book_. Besides full introductions and commentaries, a glossary, and an index, this volume contains seven appendices giving the works to which More is replying and other thematic, historical, and bibliographical matter closely related to the three works by More. Tout est parti d'une demande d'Olivier Kaeppelin, directeur de la Fondation Maeght, chargeant Bernard-Henri Levy de penser la grande exposition de l'été 2013, à la Fondation. Un thème : les rapports de la peinture et de la philosophie. Un principe : traiter à égalité, et faire dialoguer autour de cette thématique, les maîtres de l'art ancien, moderne et contemporain. Un fil directeur : une sorte de "grand récit", découpé en six stations, où l'on voit la philosophie censurer, ou réhabiliter, ou (...) effacer à nouveau, ou au contraire relayer et même remplacer, le travail des peintres. Une aventure : Bernard-Henri Levy a, pour raconter cette histoire, couru les collections privées, les musées de France et d'ailleurs, débusquant ainsi des chefs-d'oeuvre, souvent peu connus et peu vus, qui seront, du 29 juin prochain au 12 novembre, exposés sur les murs de la Fondation Maeght. Le livre enfin, né de cette aventure, est découpé en trois parties. Une longue "Lettre à Olivier Kaeppelin" (80 pages) posant les bases de l'exposition, ses principes théoriques et ceux de l'Esthetique de BHL. Un Journal, tenu de l'été 2011 au printemps 2013, et racontant, jour après jour, le "making of" de cette exposition hors-norme : problèmes esthétiques et techniques, portraits d'artistes ou de collectionneurs, moments d'éblouissement et de déception - tout y est. Jamie Ferreira has written a major contribution to our knowledge and understanding of scepticism within British intellectual life from the late seventeenth century to the late nineteenth. Her cast of characters is at first sight an unusual, even an eclectic one: John Wilkins, an Anglican bishop and founder of the Royal Society; David Hume, himself often regarded as the chief of sceptics; Thomas Reid, the Scottish philosopher of common sense; and John Henry Newman, the most famous Viotorian convert to Roman Catholicism. In Ferreira's analysis what holds this group together is their varied attempts to re· fute scepticism through an appeal " to ' the natural '-to how we are constituted, to what we, as human beings, are and do in the arena of believing " (p. vii). In other words, the refutation of intellectually derived scepticism lies in an examination of practically lived human ex· perience. Ferreira seeks to describe three distinct modes of naturalism. The first is sceptical naturalism such as found in the clearly sceptical pass· ages of Hume. The other forms of naturalism constitute replies to this sceptical position. These anti-sceptical positions are reasonable doubt scepticism and justifying naturalism. Advocates of the former contend there is no reasonable basis for doubt about fundamental beliefs of human nature. They contend that these fundamental lieliefs are more basic than other beliefs rthart are subject to justification. They are indeed the basis of our juslf:ification of other matters. For persons of ithis outlook, rationality and justification are mallters of practice. By contrast justifying naturalism does seek to provide some kind of justification that links what is natural with what can be justified. In effect, justifying naturalism rejects the argument that only one mode of justification can be regarded as legitimate. Reasonable doubt naturalism and justifying naturalism often closely approach each other, but the latter may reject scepticism on grounds other than those of practice. 53~ BOOK REVIEWS Fundamental to Ferreira's argument is her interpretation of the position of John Locke in the anti-sceptical tradition. In contrast to Henry Van Leeuwen, she asserts that rather than standing as the culmination of an earlier liberal Anglican tradition associated with John Wilkins, Locke actually departed from that anti-sceptical position which had based itself largely on the concept of moral certainty. Locke based his rejection of scepticism on a distinction between kinds of certainty rather than upon human nature itself. Whereas Wilkins and others had seen a close and sometimes identical relationship between the highest probability and certainty, Locke distinguished,the two. For him, cel'tainty had to achieve more than probability. Locke distinguished kinds of evidence from degrees of evidence. He also proposed categories of probability and demonstrated certainty hut no category of proof. This issue is crucial for Ferreira's interpretation of Hume. She contends that Hume understood this distinction in Locke and that he looked to the earlier anti-sceptical tradition. She argues that Hume thought it possible to offer a response to his own sceptical position that actually went beyond simply unavoidably accepting certain beliefs. Hume introduced a category of proof between Locke's categories of certainty and probability. According to Ferreira, he based this category on the previous seventeenth-century distinction between reasonable and unreasonable doubt. Ferreira does not claim a single unified interpretation of Hume, but urges the presence of tension in his thought that allows for the presence at least some of the time of a naturalist approach to scepticism. Thomas Reid was regarded in his day and during most of the nineteenth century as the major critic of Hume. However, Ferreira examines that critique largely in terms of shared concerns. This massive study makes an important contribution to the history of philosophy for two reasons. First of all, it stands as the most complete and careful philosophical analysis of Ockham's thought to date. Adams's expositions and analyses will become the gloss which generations of students will have to reckon with as they confront the text of Ockham. Secondly, this work represents an exemplary method of philosophical commentary, one that proves to be a remarkably illuminating way into the mind of a (...) medieval scholastic disputant. Because Ockham's thought is intensely dialectical and argumentative, Adams appropriately exposes his doctrines through an exacting recovery of his argument within its dialogical context. For example, in the crucial chapter 2, "Universals Are Not Things other than Names," we come to understand Ockham's nominalism as it emerges from his rejection of moderate realism; Adams presents this rejection through a reconstruction of Ockham's encounter with the living tradition of Aquinas, Scotus, Walter Burleigh, William of Alnwick, Nervaeus Natalis, and Henry of Harclay. As the dialectic proceeds from figure to figure, the issue of the universal reshapes itself with great sophistication. Adams's formidable analytic powers and her sharp focus on the key philosophical issue enable her to succeed in this method. The reader also gets the sense that Adams herself believes one can come to truth through philosophical argument, and not just the truth of what Ockham taught but the truth of what he sought. This earnestness enables her to keep a fix on the dialectic's "emerging rule" which becomes the source of unity in what could otherwise degenerate into a bewildering complexity of historical detail or the vanity of analytic logic-chopping. The following text is a translation of Semyon Frank’s “L’intuition fondamentale de Bergson” published in Henri Bergson: Essais et témoignages inédits, edited by Albert Béguin and Pierre Thévenaz, Neuchâtel: Éditions de la Baconnière, 1941. In this article, Frank addresses Bergson’s notion of intuition, his anti-intellectualism, his mysticism, his closeness to Lebensphilosophie, the notion of lived experience, the distinction between intuition as pure contemplation and intuition as living knowledge, the distinction between cognition of the atemporal essence of reality and (...) cognition of the world of becoming, pragmatism, the disinterested and open intuitive spiritual attitude vs the utilitarian attitude of social groups closed in on themselves, the transrational vs the irrational, spiritual life, psychic life, the Absolute, and the temporal flux. The article contains criticisms of Bergson on the issues of time and intuition: the durée, the intuitive time, is incomprehensible without an atemporal foundation. Therefore, according to Frank, Plato was correct—contra Bergson—to define time as the moving image of eternity. And, if there is such an atemporal foundation, then, contrary to what Bergson seems to think, intuition as living knowledge cannot be the sole mode of intuition. Moreover, unlike what Bergson appears to think, an intuition of the Absolute would be an intuition of the transrational rather than of the irrational. RichardsonReview: Philip Kitcher, Science in a Democratic Society, Prometheus Books, 2011In examining the place of science in a democratic society, Philip Kitcher is ultimately asking what standards scientific activity is answerable to. Here, as in Science, Truth, and Democracy (Oxford University Press, 2001), he rejects two extreme possibilities: first, the suggestion that science is autonomous, in the sense that (...) it is answerable only to its own standards; and, second, the suggestion that it is answerable to “vulgar democracy”—that is, to unconstrained majority rule by untutored citizens. In this book, as in the earlier book, he deploys the idea of “well-ordered science,” which he seeks to characterize in part by leaning on the idea of a hypothetical, ideal conversation. Crucially informing this newer book is a much fuller account of nonvulgar democracy. Underlying that account is a much broader picture of “the ethical project”—the title idea of another important Kitcher book from 2011 (Harvard University Press).In order to motivate the friends of science to turn to these broader ethical ideas, Kitcher persuasively rehearses the case against value neutrality in science. Much current distrust of science and scientists, he argues, derives from scientists falsely pretending—whether deludedly or cynically—that science can proceed in a value-neutral way. It cannot do so in resolving competitions among theories, let alone in setting the research agenda or weighing in on practical problems of public concern. By wearing a false mask of value neutrality, scientists succeed only in convincing the public that they are ideologically driven. This, in turn, gives an opening for dissenters motivated by religion or by their own ideologies to develop supposedly scientific counter-claims of their own, such as those that assert creationism or deny the reality of climate change. Better, then, for science and scientists to be frank about its lack of value neutrality. [End Page E-106]What values ought to inform science? To answer this question, Kitcher turns to his conception of the ethical project, of which Chapter 2 gives a summary. As he conceives of ethics, it arose pre-historically as a set of mechanisms helping us to deal with deficiencies in altruistic motivation. Although inspired by evolutionary theory, Kitcher spurns the sociobiologist’s identification of the good with the adaptive. Instead, while giving an elaborate reconstruction of how our ethical practices may actually have arisen, he gives pride of place to the idea of conversation. On his reconstruction, the “egalitarian plateau” touted by Will Kymlicka (Contemporary Political Philosophy [Oxford University Press, 1990], p. 5) and others as the great achievement of the Enlightenment was merely a delayed philosophical echo of the ethical project’s initial feature, one that would have been found in the ethical discussions of human hunter-gatherer bands of forty-thousand years ago. Being more focused on how life is lived than on philosophy, Kitcher, fairly enough, is unwilling to see the Enlightenment as an egalitarian age. Rather, most recent incarnations of the ethical project have been distorted by hierarchies and inequalities. Emphasizing the word, Kitcher writes, “I propose... that we undo the distortion,” and model the ethical project, going forward, as involving an egalitarian conversation. This frankness disarms any worry about the move from ‘was’ to ‘ought’ that might have arisen in the minds of those already puzzled by the current popularity of the cave-man diet; and in any case, since Kitcher’s account of the ethical project is defended at length in his contemporaneous book of that title, doubts about it would be better addressed in that context. Rhetorically, since the ideal of treating persons fundamentally as equals is even more popular than eating meat, he is on strong ground here.The book develops this core egalitarian proposal in three distinct ways, thereby gaining a rich evaluative basis for considering the place of science in society. The first is an account of the purposes to which science is answerable.
